As you know, the pool at Creekside remains closed. Unfortunately, Arizona is in a worse place with exposure to COVID-19 then it was when the pool originally closed.
The Board of Directors continues to work with the management company, the insurance company, and Association’s attorney with respect to possible reopening. At this time, with the liability exposure the Association faces, the Board of Directors has voted for the pool to remained closed.
We are taking advantage of this time and doing some necessary upgrades to the pool, bathrooms, and equipment room.
The Board thanks you for your patience and understanding as we understand the heat in Arizona is difficult without the pool. Below are some resources for COVID-19.
Also, in hopes to push towards the reopening of the pool Arizona House of Representatives has passed a liability shield and Governor Ducey advised he would support this bill. In order to make it to the Governor’s office, the Arizona Senate must also pass this bill. The Association’s attorney suggests you to contact your state legislators to urge them to pass this bill. The attorney has drafted language for you to provide: “Our community pool is closed. It is our understanding our community has no insurance in the event it is sued for a Covid-19 infection. If the lawsuit is a class action, the judgment could cloud the titles of all our homes in the event we can’t pay it. We can be sued even if we follow all of the Governor’s Guidelines. The pool closure is causing anger and frustration within our community. We implore you to pass some liability protection so we can use the pool in the Arizona heat.”
