Today Governor Ducey issued Executive Order 2020-33. This Executive Order extends the state’s “Stay home, Stay healthy, Stay connected” policy through May 15, 2020. The Executive Order continues the requirement for Arizonans to limit time away from home except for Essential Activities. The Executive Order requires physical distancing while encouraging “social connectedness.” This firm understands the tremendous pressure put on Boards and management to reopen pools, tennis courts, and pickleball courts. Today’s Executive Order did not provide for the opening of semi-public communal pools or spas. Unfortunately they must remain closed. The penalties for violating include a $2500.00 fine. Associations are legally required to follow this Executive Order. Our firm hopes that on May 15 the pools might reopen with social distancing practices. Our firm is assembling social distancing options related to pools and will be ready on May 15 in the event Governor Ducey allows them to reopen at that time. Our firm is continuing to monitor the situation closely. Based on the Executive Order the Association may allow the use of tennis and pickleball courts only after the Association sets up a strict and enforceable use schedule and sanitation guidelines, and the Member agrees to waive and indemnify the Association.
